  • Describes the types of information we may collect from you or that you may provide when you visit our websites www.zyus.com, www.zyus.ca and other websites operated by ZYUS that display or link to this privacy policy and the services through such websites (together, our "Websites").

Privacy laws in Canada generally define "personal information" as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person. 

Health information and privacy laws in Canada generally define “personal health information” as information relating to a person’s physical or mental health, their health history, medical records, prescriptions and health card numbers.  

In this Privacy Policy, the term personal information also encompasses personal health information as appropriate.  

This policy applies to personal information we collect, use, or disclose about you related to:

  • our Websites
  • in email, text, and other electronic messages between you and our Websites;
  • Our mobile apps, social media properties and other online services;
  • Our events and business development activities;
  • Communications and other online and offline business interactions we have with you,

(collectively, our “Services”).

Our Websites and Services may include links to third-party websites, plug-ins, services, social networks, or applications. Clicking on those links or enabling those connections may allow the third party to collect or share data about you. If you follow a link to a third-party website or engage a third-party plugin, please note that these third parties have their own privacy policies and we do not accept any responsibility or liability for these policies. We do not control these third-party websites, and we encourage you to read the privacy policy of every website you visit.

Consent
Please read this policy carefully to understand our policies and practices for collecting, processing, and storing your personal information. If you do not agree with our policies and practices, your choice is to not use our Websites and Services. By accessing or using our Websites or Services, you indicate that you understand, accept, and consent to the practices described in this policy. This policy may change from time to time (see Changes to Our Privacy Policy below). Your continued use of our Websites and Services after we make changes indicates that you accept and consent to those changes, so please check the policy periodically for updates.

Information We Collect About You
We collect and use several types of information from and about you including, but not limited to: 

  • Personal information: To access portions of our Websites and Services, you may be required to provide your birth date and location. For example, to purchase medical cannabis in Canada from our commercial website www.zyus.ca:
    • you will be required to register as a patient or caregiver by creating an account and completing the patient application form. When you register, we will collect personal information you provide on the application form. On the application form, we will collect personal information including, but not limited to, your first and last name, date of birth, phone number, email address, gender, shipping address, mailing address, physical address, health care practitioner name and contact information, insurance policy information (including your policy number and policy provider) and whether you are a Canadian veteran, and if applicable your caregiver’s first and last name, gender, phone number, email address, and date of birth; and, 
    • we also require a document known as a “Medical Document Form” completed by your health care practitioner be submitted, which includes information including, but not limited to, your health care practitioners’ name and contact information, their jurisdiction of registration and medical licence number, your first and last name, date of birth, telephone number, email address, address of consultation, and your authorization (including daily quantity and duration of use) as well as additional comments regarding dosing directions, if provided by your health care practitioner. ZYUS collects this information to confirm your registration status and fulfill the purchase of your medical cannabis.
  • Technical information: technical information collected, used and stored includes, but is not limited to, your browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, or information about your internet connection, the equipment you use to access our Websites and Services, and usage details.
  • Non-personal details about your Website and Services interactions: non-personal information collected used and stored including, but not limited to, the full Uniform Resource Locators (URLs), clickstream to, through and from our Websites (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, or any phone number used to call our customer service number.

How We Collect Information About You
We use different methods to collect your information including, but not limited to, through:

  • direct interactions with you when you provide it to us, for example, by filling in applications, forms or corresponding with us by phone, email, chat or otherwise; 
  • automated technologies or interactions, as you navigate through our Websites and Services. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies;
  • our interactions with third parties who may hold your information, such as your health care practitioner or other third parties and service providers such as social media sites or third parties providing analytics and targeting services respecting how individuals use our Websites and Services.

Information You Provide to Us 
The information we collect directly from you on or through our Websites and Services may include:

  • information that you provide by filling in applications and forms on our Websites and Services. This includes information provided at the time of registering on our www.zyus.ca website to be a patient, registering to access the health care practitioner portal or any other use of our Websites or Services, subscribing to our mailing lists/ newsletters, online forum and/or requesting further services. We may also ask you for information when you report a problem with our Websites or Services.
  • records and copies of your correspondence (including email addresses), if you contact us.
  • your responses to surveys that we might ask you to complete for research purposes.
  • details of transactions you carry out through our www.zyus.ca website and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our www.zyus.ca website.
  • your search queries on our Websites or Services.

Information We Collect Through Cookies and Other Automatic Data Collection Technologies  
As you navigate through and interact with our Websites and Services, we may use cookies or other automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • details of your visits to our Websites and Services, including traffic data, location data and other communication data and the resources that you access and use on the Websites and Services;
  • information about your computer and internet connection, including your IP address, operating system, and browser type.

The information we collect automatically is statistical information and may include personal information, and we maintain it or associate it with personal information we collect in other ways, that you provide to us. It helps us to improve our Websites and Services and to deliver a better and more personalized service, including by enabling us to:

  • estimate our audience size and usage patterns;
  • store information about your preferences, allowing us to customize our Websites and Services according to your individual interests;
  • speed up your searches; And,
  • recognize you when you return to our Websites and Services.

The technologies we use for this automatic data collection may include but is not limited to:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Websites and Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Websites and Services. 
  • Web Beacons. Pages of our Websites, Services and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity). 

Information from Third Parties
As noted, we may receive information about you from third parties: 

  • Information Provided by your Health Care Practitioner: To purchase cannabis for medical use in Canada, ZYUS will also require that you submit a Medical Document Form (as described above). 
  • Other Third Parties: We may collect or receive certain information about individuals from service providers, and other third parties, such as social media sites (for example when you interact with us or our content on these sites, as well as other public sources and records. 

How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information for the following purposes:

  • Providing Support and Services: To operate our Websites, provide our Services, communicate with you about your use of the Websites or Services, provide troubleshooting and technical support, respond to your inquiries, fulfill your orders and requests, process your payments, communicate with you, and for similar service and support purposes.
  • Responding to Your Requests: To respond to your inquiries, fulfill your orders and requests, and otherwise consider or process your request.
  • Personalization: To tailor content we may send or display to you, including to offer location customization and personalized help and instructions on our Websites and Services, and to otherwise personalize your experiences.
  • Newsletters and Direct Marketing: For direct marketing purposes, including to send you newsletters, client and investor alerts and information we think may interest you.
  • Protecting Legal Rights and Prevent Fraud and Misuse: To protect the Websites, Services and our business operations; to prevent and detect fraud, unauthorized activities and access, and other misuse; where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety or legal rights of us or any person or third party, or violations of our Terms of Use or other agreements; and to respond to actual or potential legal claims against us.
  • Complying with Legal and Regulatory Obligations: In order to comply with our legal, regulatory and compliance obligation. For example, to verify an individual’s eligibility for registration under the Cannabis Act (Canada) or to respond to legal process (e.g., court orders, subpoenas or warrants) or regulator investigations and inquiries, or where otherwise required by law or our legal or regulatory obligations.
  • Analytics and Improvement: To better understand how users access and use our Website, products and Services, and for other research and analytical purposes, such as to evaluate and improve our products and services and business operations, and to verify that orders are being fulfilled and tracked in compliance with the Cannabis Act (Canada) or any other applicable local legislation.
  • General Business Operations: Where necessary, for the administration of our general business, accounting, recordkeeping, audit, compliance and legal functions. in any other way we may describe when you provide the information;
  • for any other purpose with your consent.

Disclosure of Your Information
We may disclose personal information that we collect or you provide as described in this privacy policy or as required or permitted by applicable law:

  • with your healthcare provider and your authorized family members and individuals designated by you as caregivers; 
  • to our subsidiaries and affiliates;
  • to comply with applicable law and regulations;
  • to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of ZYUS’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by ZYUS about our customers and users is among the assets transferred;
  • to contractors, service providers, and other third parties we use to support our business (such as analytics and search engine providers that assist us with Website improvement and optimization) and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this policy;
  • to enforce or administer our agreements and terms, or for fraud prevention, risk assessment and investigation, and to product and defend the rights, property or safety of ZYUS, our clients, our customers, our investors or others;
  • for any other purpose disclosed by us when you provide the information;
  • with your consent.

Transferring Your Personal Information
We may transfer personal information that we collect or that you provide as described in this policy to contractors, service providers, and other third parties we use to support our business (such as analytics and search engine providers that assist us with Website and Services improvement and optimization) and who are contractually obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this policy.

We may process, store, and transfer your personal information in and to a foreign country, with different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country. Whenever we engage a service provider, we require that its privacy and security standards adhere to this policy and applicable Canadian privacy legislation.

By submitting your personal information or engaging with our Websites or Services, you consent to this transfer, storage, or processing.

Data Security
The security of your personal information is very important to us. We use physical, electronic, and administrative measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We store all information you provide to us behind firewalls on our secure servers. Any payment transactions and personal information will be encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Websites or Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. 

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Websites and Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our Websites or Services. 

Data Retention
Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent. 

Accessing and Correcting Your Personal Information
It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes. 

You can review and change your personal information by logging into the Website or Services and visiting your account profile page and using the forms provided (where applicable). 

Withdrawing Your Consent
Where you have provided your consent to the collection, use, and transfer of your personal information, you may have the legal right to withdraw your consent under certain circumstances. If you have opted in to receive certain emails from us but no longer wish to have your email address/contact information used by the Company to promote our own products or services, you can opt-out by logging into the Website or Services and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to care@zyus.com. If we have sent you an email, you may unsubscribe by clicking the unsubscribe link we have included in the email. This opt-out does not apply to information provided to the Company as part of a product purchase, product service experience, or other transactions. Please note that if you withdraw your consent we may not be able to provide you with a particular product or service. We will explain the impact to you at the time to help you with your decision. 

Changes to Our Privacy Policy
It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users' personal information, we will notify you. 

We include the date the privacy policy was last revised below. You are responsible for ensuring we have an up-to-date, active, and deliverable email address for you, and for periodically visiting our Websites, Services and this privacy policy to check for any changes.
